Under English common law rights. I have been told that I'm should give my details to the police. Just looking at the moment not British rights or UK rights. as I have seen on the internet that I don't have to give my name and address to the police. And then I see under the English bill of civil rights dating back to 1680. I must give my name and address in England to the police and even the Queen took a oath that the EnglishBill of Rights still stands.

Call 999 due to an altercation with ex husband and in-law , they came out starting commenting on the house my son and grandkids were there ,they since left and come to my son's house gone in and starting asking children what food they eat and then gone straight to the fridge and demanded the children arnt fed as not healthy food in there look in cupboards ,now call social services , this is not on what's my right as this is nothing to do with the callout and a different address, it's not right ,

A man who has been trying to get into a relationship with me was arrested. He was being very disruptive in the police station demanding my details saying I was his wife. The police gave him my full address and phone number and he proceeded to inundate me with calls and letters. This is disturbing to me and I am really upset that an extremely violent man was given my personal details by police, I am in fear now every time I leave the house. What can I do ?

I was parked illegally with my hazards on, i was in the shop 30 secs 40sec max.
I was letting cars by b4 getting into my car safely when an officer stopped his viechle next to me & wound down the front passanger window,
I felt a tad humiliated that he had a civilian sitting in the car whilst giving me the 3rd degree from the driver's side & over the lady. Is this allowed & propper practice regardless of me being in the wrong or not?

I was parallel parking and I apparently jolted an off duty officer cars whilst parking. I strongly disagree that I even touched his car however he flashed his police badge and demanded I exit my vehicle to "have a chat" after I initially refused to get out and talk with him. for the sake of ease I talked with him and we came to the conclusion there was no damage, I told him I strongly believed I didn't hit his vehicle and told him its his own opinion that I hit his car. he then left but the pig wasted my time and tried to flash his badge and an attempt to get me to even talk with him about the CIVIL matter.

I was wondering under what authority can an off-duty officer request me to exit my vehicle over a civil dispute?

This is more of a hopeful quiery than anything else. Recently I arrived home to be told by my neighbour that a plain clother police man had been looking for me by name. He then proceeded to give him my mobile number. That day I contacted the local police helpline but they couldnt help me. Today I received an unknown number call (as usual I never answer them) there was no voice mail. Not long after my neighbour contacts me to inform me he had received an unknown number call it was this police man again saying he had been unsuccessful in contacting me. Now I find this odd. So I ring my local police station and they run a check on my name and address, they also put out a radio call to request if any on duty officer was looking for me. He said none he was aware of. I find it really strange they would not leave a message or leave a card with information on how to contact them. I find it even more odd he would search my neighbours files to find his number to call him today again without attempting to call at my house after already knowing I am not back from work until after 6pm and this so called event took place at 3pm so he says today? From what my neighbour says he stated I was not in trouble and it was nothing to be concerned about but frankly its stressing me out. How do I know if I'm being played a prank on or if this is actually real? Surely if it was official police business they wouldn't be this sketchy? What can I do? Its really freaked me out :(

I received a phone call from police station saying that there are allegations against me for harrassment and criminal damage! It’s my ex telling lies about me and i suffer from anxiety and depression - they want me to come to the police station to be interviewed and are providing a solicitor but i’m very scared

We have right of access to our parking area in our deeds. 13 years ago, a restaurateur opened a bistro and asked if he could put 2 bins outside his rear door (fire exit only) as he has no legal space there. I agreed. Over the years this has grew to 4 large and 3 normal sized bins plus bags, crates and baskets at times. On occasion, broken glass is found on our driveway and I’ve spoken to his staff but never the chance to him directly. Last week however, large stainless steel tables etc were placed on a small plot of land that I maintain (not mine) to reverse out onto so as I can drive forward out onto the main road. Not being able to get anybody from the bistro I parked my wife’s mobility car in front of bins knowing that he would have to contact me to move them. The police came on their behalf to ask me to move my car. They now are saying they have the legal right to have bins there because of recycling. Not wanting to escalate things I moved car. This is private land in Scottish town and would like to know if the police can enforce me moving car and if they can force their bins on my space? Thank you.

I have had an uncle ring the police yesterday as I stopped at my nans house on the way to my mom's. She was on the phone to him as I arrived and she just said to him that I was there, it was only a flying visit so as I was walking when I left nans I saw this police car go past me a few times as I continued to walk I saw this pc parked up in a side street he got out and asked for a word with me, I replied that I was in a rush and he said I may be under arrest so I had to speak with him. He asked if I had been to my nans I said yes then if I'd had money off her no I replied, then if I had my nan's bank cards? Why would you ask that of course I haven't, then he asked why I'd stopped at ATM who's cards did I have? My own I said he asked if I'd said anything about suicide to my nan? What a weird question I thought then after when I spoke to my nan she said the female pc had told my nan I was on drugs surely this is an infringement of my rights

Basically i have had nuissance complaints from my neighbours for any little noise
This friday when they came, things got slightly out of hand, due to the feeling of harrassment and irritation of them constantly coming for absouloutely nothing
I opened the door and they just walked in, I pushed the officer as i wanted him out of my property, he then continued to square up to me and say for me not to push him, they had no warrant and was there for a noise disturbance, i was pretty intoxicated and fed up of them showing up, it was litterarly making me feel distressed and decided to give him a tuning, which all took place in my property, how should i go about all of this? Am i aloud to beat up a police officer if he is to just walk into my property without permission? as it's really taking the piss, I am in court of the 25th of this month for the offence, and am just trying to fight the case every way i can, back up was called, and i was beat the hell out of by about seven police officers, i left the station covered in cuts and bruises
Is there any law which would let me get away with this in terms of him entering the property without a warrant?

Hi, I just wanted advice about police continually knocking on the door after midnight, every night now for 4 consecutive nights and it is likely to continue. My brother's girlfriend is in care and has a curfew for 11 o'clock. Since we have been made aware of this the young lady has not and will not be staying at our residence after this time. We have informed the police of this, however, when the girl is not in her care environment after this time the police continue to come to our house at 1 or 2 in the morning. This has been quite distressing as everyone in the house gets up very early for work and when all the pets are disturbed it's hard to get the house calm again. Do we have any rights in relation to getting this stopped? I'd really appreciate any advice.

A police officer can stop and question you at any time. They can ask fo details such as your name, what you're doing and where you're going. You do not have to answer any questions if you don't want to.

I'm sitting in a Pub garden with my elderly disabled neighbour, who I take shopping at least once a week, having dinner. A Police officer tried to enter the premises stating to his collegue 'I want a word with him'. His collegue replied 'Leave him he is with someone'. and they walked away. Can a Police officer enter such premises, or, stop you in the street just to 'have a word'?
I am registered disabled and have Tourettes Syndrome. As a result I become distressed easily. I'm afraid this officer is intent on causing distress resulting in him creating a situation which then gives him lawful cause. If I am doing nothing wrong surely stopping me in the street to 'Have a word' is illegal?

Both my son's have been stabbed 3 times by a local gang and are now being harassed by police. Police have issued an Osman warning to my older son but keep coming to my property to find him even though I have taken him off my tenancy and formally complained he does not live with me and to ask them to stop knock my door. They have no evidence that my son is a criminal and he does not have a criminal record yet police will make remarks like because of your criminal activity that's why the gang are after you. Even though we have explained it is for another reason of informing on them! Police have searched my house without a warrant and good reason at 3am waking my small children and been coming to my property every month for around 6 months now. I'm fed up and have basically have them put my son's life in danger demanding him to come to my house at midnight to sign an Osman warning. Yet they claim they come to my house and his step dad's house to check he is ok, last time they came my son was stabbed for a second time. They have been asked for over 6 months for a risk assessment by my housing but are refraining from doing one even though the last stabbing took place outside my house and I have small children!! I'm at my wit's end with worry and don't know what I can do!!!

Tonight my 19 yo bro got arrested for getting abit too involved with an arrest that was already happening. 6 police men jumped on him, one of them kneed him, and another hit him in the face resulted in his mouth bleeding..when i said didnt take so many of them to arrest him and was out of order the force they used cause he has rights, one police officer said what rights, i said well the right for your to not to do that to start with his reply was can hit him in the face if we want to nothing you can do. I just want to kno what is classed as excessive force? Six men on one boy is extreme to me. Just want to know his rights? People on the street believed his arrest was out of order too. Wouldnt give us badge numbers. Just what are our rights? How do we complain?

On Saturday and again on Monday, I had two arguments with a dog owner who refused to control his dog despite the dog barking at my frightened child for ten minutes. He threatened that I would get 'hassle'.

On Monday night, at about 3am the police knocked loudly on my door. I did not answer as I am a single parent of a 10 yr old child, and I did not want my child to be afraid.

Also two years ago, I had a similar experience when the police 'claimed' to have the wrong address. Then I lived in a quiet semi-rural area. Now I live in a rural, well-to-do, crime-free area.

When I called in South Yorkshire Police yesterday morning, they were unable to provide any information, and were rude as well.

Do I have the right to demand to know why I was so rudely awakened? Must the police provide me with this information?

This article is unhelpful and misleading. It states "If they [police] ask for personal details such as your name and address then these should be given".

You are NOT required by law to give your name or any personal details to the police if you haven't committed an offence and aren't stopped driving a vehicle.

It's worrying that this website is spreading incorrect information.

When your released on bail the police have 28 days to file charges unless they get a 3 month extension. But what if the police break the 28 day deadline without a judge granting the extension. Have they violated my rights by breaking procedure

A policeman who assaulted me was found guilty in magistrates court. He appealed and his sentence was quashed in crown court
The police force then used the current guidelines and he only got a report on his record instead of a disciplinary hearing and dismissal

Seems they are able to protect thier own and I have no further right to appeal
Lies in court transcript I have copies of are shocking

What was the court response when you told them it was your debt? We suggest you go to local Citizens' Advice or a contact a debt charity like Step Change before making your decision.

Ok I'm in messy situation. When my daughter went off to uni I couldn't afford to get her the things she needed in one go so I stupidly opened catalogues in her name without her knowledge. I intended to order the things she needed, pay them off and close the account. I paid regularly but my husband had a stroke and I fell behind. She's now got 2 ccj's on her credit file because of me and I feel awful. By trying to help her I just made a big mess. I've satisfied both of the debts and I've written to the court who issued the ccj's to explain it was my debt not hers. I've told her to report it to the police because it's the o my way to clear her file but she's reluctant because she doesn't want to see me get into trouble with the police. What I did was wrong despite the reasons behind it. What will happen next if she goes ahead to report it? Will I be arrested for it? We're both in a mess over it all

Hi my daughter has to go for an interview at the police station but there both evening appointments one was 8.30 pm and the other was 10.30 pm I thought they said 10.30 this morning so went to the police station with my daughter to find out its 10.30 pm so I told them at the police station I couldn't do evenings I'm disabled with no transport the office I spoke to on the phone said if I didn't take my daughter to this interview there would be a warrant out for her arrest I'm worried even though the lady I spoke to today at the police station said she would email them and let me k ow with a phonecall later tonight as the officer isn't at work till 10.30 tonight

We don't really know for sure. This is from Citizens' Advice:
"...police must have a search warrant before they can enter the premises. They should enter property at a reasonable hour unless this would frustrate their search. When the occupier is present, the police must ask for permission to search the property – again, unless it would frustrate the search to do this.

When they are carrying out a search police officers must:

identify themselves and - if they are not in uniform - show their warrant card, and
explain why they want to search, the rights of the occupier and whether the search is made with a search warrant or not.
If the police have a warrant, they can force entry if:

the occupier has refused entry, or
it is impossible to communicate with the occupier, or
the occupier is absent, or
the premises are unoccupied, or
they have reasonable grounds for believing that if they do not force entry it would hinder thesearch, or someone would be placed in danger.
When police can seize property
Police should only seize goods if they have reasonable grounds for believing that:

they have been obtained illegally; or
they are evidence in relation to an offence.
In either of these cases, they must also have reasonable grounds for believing that it is necessary to seize the goods to prevent them being lost, stolen or destroyed."

Can the police execute a search warrant and seize goods if there is only a 15 year old girl in the property. She wasn’t given the opportunity to get an appropriate adult or anything. And would any evidence be accepted in court?

You don't see anything wrong with a police officer male on his own starring in my windows im a single parent female with a clean police record I am being harassed for no reason there are drug dealers in my area and they drive straight passed their houses yes I will go speak to a senior officer

The local beat officer round my area drives passed my house late at night really slow starting in my house this happens most nights when I have approached him he said he was looking for someone I said what in my house and he just said no I'm doing my rounds yet he only slows down for my house it's getting to the point where I feel that intimidated I don't want to live in my house any more how do I complain about this should I keep a diary of all the times he does this he generally by himself aswell when he does this ??

having a neighbour disbute with the tennants next door, the police have all ready given me a formal warning, and the land lord, for harrasment.The police came back to my property, i refused to answer the the door, do they have a right to beak in to interview me? i made it quite clear to the officer and the councllor who was present , that if they had to retun i would not be co oprative.

Under normal circumstances, police officers should not use BWV in private dwellings. However, if a user is present at an incident in a private dwelling and is there for a genuine policing purpose, they are entitled to make a BWV recording in the same way as they would record any other incident.

There is a dispute over a horse. The money was originally paid for by selling another horse that belonged to me. I then agreed to develop this new horse and sell on with the intention of splitting any profit with another person. Profit being anything over the original stake, I.e what the horse cost to buy. The horse is still not sold but I'm being hounded to pay over money that they perceive is profit. They are now stating that they will remove the horse into their care to sell and are going to bring a police escort to facilitate the removal. Is this action legal. Can the police do this. This has not gone to solicitors nor has anything gone through the court. No legal representation at all. Not even a letter stating. Only made aware of this through text messages. Please advise

Me and my friend used to work days in carehome with metal patients and one day something happened to one patient he had bruise all over his body and face and some how he told other staff our name so next day at work police came to get us to station without saying anything and we got searched , interviewed and took our phone and shoes and put us on bail and we were suspended from work, after 4 months police called us saying our bailed is done its no more and we like ok so whats gonna happen ? They told us we have to wait for letter. I was ok then after 14 months we were called at work place to intervew once again so did it and after a week got a letter saying we are sacked so i was like after all this time we get sacked and we asked the manager from our work place why it was this long they said cause the police took long time and now its been 16 months we were summon on court now it says we are going to crown court and now its for more trial and my solicitor says its gonna finished next year so is this even possible? Not being told nothing for 16 months and staight to court?

My ex's wife has been receiving messages about my ex and me via social media. They have gone to the police and they said they will investigate. I received an email from a PC stating that she wanted to know if I know who is sending these messages because they amount to harrasment. Then she went on with the following quote ;
"I would also like to request that you do not contact Adam or any of the Smith family either in person or by any third party and by any method of communication, continuing to contact them in any way may mean that further action may be taken against yourself for any offences."
Obviously I had contact with my ex (he wasnt my ex until about 12 hours prior to the PC's email) and I had sent a message of apology to his wife that day.
I feel confused (am I a suspect? Why am I not allowed to contact them?) and intimidated (action will be taken against me for any offences)

I have 2 questions; if I am a suspect, would the PC not have to inform me of this fact and secondly, is this PC allowed to warn me like this when I have done nothing to warrant a threat of actions being taken against me.?

They won't charge you. They're probably trying to keep other women/girls safe from this person by getting some more information from you and making sure you definitely don't want to press charges now that you're sober.

Hey I was involved in a strange situation last week. I was out with friends drinking and got too drunk and cannot remember getting into what I thought was a taxi but turned out was not I got destrssed as the man from what witnesses told me would not let me out of the car they called the police even though I got out with their help and did not want police involved they turned up took my details and I got a taxi home I advised that night I wished to take it no further and just wanted to get home . They are now requesting I come make a statement to say I don't wish to take it further but I'm worried they will try charge me for being drunk can that happen ? Thanks

Me and a friend are cat breeders, we agreed to do a deal and exchange cats to better our programme, we been planning this for two years.. She let me take her cat and I agreed to allow her a female breeder when one available. She has now changed her mind after asking for some updated photos, leaving my programme out of money, the cat has bonded with the rest of mine, I am willing to see my side of the deal through, but now she has cut contact and called the police on me . Where do I stand on this ?

My partner and I arrived home the other day to find a notice of the powers to search premises and the rights of occupiers. The statutory power under police and criminal evidence act 1984 and codes of practice.
And with the section 17 box ticked? What does this mean and does it mean they are coming back.

Even though your husband is the sole tenant, if you invested time or money into the property (including bringing up children), you may be able to prove an "interest" in the home. You may need to seek advice from a solicitor in order to apply for an occupation order. As we don't know how long you shared the property and whether you have any children together etc, we can't really advise. If you can't afford a solicitor, try Citizens' Advice who may be able to find you some free legal help.

Gosh that's a complicated one. Legal advice would be our best suggestion to be honest. You need to take the DVLA to task over this...they should not revoke a licence on medical grounds on the strength of one phonecall from somoenbe who's never even met you. It's really not clear which conditions you are compelled to tell the DVLA about and which ones you must tell them about it you think it will affect your driving. See this page which mentions aspergers but merely says "You must tell DVLA if you have Asperger syndrome and it affects your driving".

My husband is a sole tenant. Marriage has. Broken down he left the home 5 weeks ago voluntarily. I have occupancy rights by law. He wants to return to the property. Legally I cannot stop him. He cannot remove me either. He called the police to remove me. The police bargained with me to let him return for a week and I leave. I felt pressurised into agreeing as I had no choice so that he and they would leave. It all got too much for me so I verbally agreed. I reported this to my already crime report number later that day. He is coming today again with the police to have me removed. I have tried to be amicable and have agreed he can return while we sort things out, although not as my husband. I have no where to go. I live here with my daughter and his daughter both aged 20. They do not want to be involved. Can the police make me go?

I recently sent off to DVLA to update my address and photocard very belatedly. I received a letter back informing me my licence had been revoked the previous year without my knowledge. Apparently when I reported a crime I was the victim of, a police officer who spoke to me on the phone then called DVLA to revoke my licence. Driving was not part of the crime which was theft from my bank account but I had mentioned I had Aspergers do he decided I should not be driving. I had held a full clean licence with no points or stops for 12 years before being diagnosed so my consultant said it clearly didn't adversely affect my driving, more likely making me a safer driver. One 50/50 accident in 2006 on a roundabout. Driven about 100 000 miles here and in France. No criminal record whatsoever, nor ever questioned about a crime. No mental or physical health issues except the Aspergers. I am a professional in the same job for almost two decades and I'm a graduate yet the officer who spoke to me has suggested I'm mentally challenged in some way. Can't get DVLA to tell me the exact allegations but GP has confirmed he wasn't contacted and written a letter of support which DVLA has rejected. He's been my GP for 21 years. He is flabbergasted, as am I. Devastating and completely unjustified. Any ideas please on how to proceed?

My friend got a visit off a company with a civil warrant. Can the police get involved on this kind of warrant? She refused the company entry so they called the police the police asked hers to open the door so the company could gain entrance again she refused the police officer then started threatening us if we didn't open the door they would open the door with the big red key (battering ram) they did this is this legal? Also they twisted something she said and said she was threatening to take her own life so used that as the final reason for entering the house with the battering ram. Once they gained access she was threaded with arrest for breach of the peace of she did not move out of the way to give the company access is this all legal she recorded most that was going on because she was in gear for her own safety

My son received a court summons ,it said he was searched at a music eventand police found a small bag of cocaine and 4 pink tablets and was escouted of the premises. My son did attend this musical event ,but was not searched or questioned by the police,and did see police escort an acquaintance of the premises.Is it possible for this acquaintance to have given my sons details.

My son was out with friends and had a lot to drink, while he was in the toilets being ill a person know to one of his friends verbally religiously racially abused another man. Yesreday the police contacted my son by phone and asked him to come in for an interview and told him that if he didn't come in voluntarily he could be arrested. He says he doesn't know anything about it as he wasn't there at the time and has agreed to go in as he wasn't involved. The fact that they have threatened him with arrest if he doesn't go in voluntarily surely means that they are planning to do so when he gets there and he's convinced he's safe to go on his own for a "chat"

My husband is a director of a company which a customers is in a dispute with. This is a civil matter, however the police were involved by the customer. What are my husbands rights with regards to the police and being a civil matter can they arrest anybody?

I have recently had an excluded occupier try and gain entry to my property, she was on camera, my body guards where there, however her parents showed their badge and threatened to arrest my security team.
I have video evidence of all of this as I was on holiday, however, the police came and took my cctv. The excluded occupier changed the locks with a lock smith after trying to climb in through a window. Because my formers friend parents are Polk e officers I believe be police who where called on the day where biased. I have of course made complaints etc but how can my evidence be used? Even though my security team had a key to gain entry the police told me (the hardrive has not been logged so they don't know where it is) but also the footage could be used against me or my security team!? Is this correct?!
Any help on this matter I would really appreciate :)

The police knocked at my door yesterday saying they see me driving the car the day before on the phone ( they were on foot) and told me to put the phone down and I refused and stuck my middle finger up and drove off they took the number plate down and got my address ( which is about 150 yards from where it took place) it wasn't me as I'm not insured in the car I have a work van and the car is registered to my wife who was away they have given me a £90 fine for the middle finger and a court summons for the phone situation what do I do as they wouldn't listen to me at the door

The police in Scotland are the worst. Been unlawfully detained/stopped and searched over 30 times, sometimes under sections of the law that do not exist. There is no recourse for victims of racist barbarity by Police Scotland.

An assistant investigator working for the U.K. Police sent an email to my place of work stating I was a "person of interest" and implicated me in a serious crime, this was implicated by 4 different inclusions within the email.
I am not
I have never been arrested.

This was a knowingly malicious act part of an ongoing vendetta against my partner by the police.
This has caused vicious rumours that could endanger my life and certainly will cause major problems for me.
Can I sue the person for libel?

Police came to my house with a search warrant and arrested my 19 year old son . They said that they have tell me to leave my house for (10 hours ) In fact . On the warrant it pacifically says they are searching for certain clothing and shoes on it . So would they not allow to be present in my home whilst they searched it . I am disabled with my spine and struggle to walk because of the pain , even so they said they need to search my home without me being present , I was in so much pain that day . Was what they did breaking their code of practice ? What is my rights ? And can I take the police to court for it if it is illegal what they did ?

As long as you are not contravening any parking restrictions and there are no local regulations relating to commercial vehicles in residential areas, there's not much the police can do.

I have fell out with my neighbors opposite me because of my van parked outside there house. It is not blocking his drive and is parked in between his house and his next door neighbor. Do the police have any rights telling me to move the van or them moving it for me. I have tools in there and I feel I need to keep it there to keep watch over it.

On the 27th two officers came to my home and arrested my boyfriend for revoke Bond my boyfriend had my car keys and Bluetooth headset on him I watched one of the officers take both off of him and stuck car keys in his pocket and Bluetooth around his neck then the officer came inside and looked around the house and left when I went to leave to try to see what I could do to get my boyfriend out I could not find my car keys nor my Bluetooth headset I called the officer and he said that he put them in my house with all his other belongings that was with him on the kitchen counter I have tore my house apart trying to find them now the officer says he isn't sure what he did with them and have yet to find my keys and Bluetooth headset it is going to cost me a $250 to get another key for just my ignition switch that is not counting changing the door locks. what can I do or what should I do because of the officer lost or misplaced my Keys? Because I can not afford that.

I was stopped at the airport to have my passport checked randomly. The two officers tried to make small talk. They kept asking me questions about my work. At one point I asked them why that matters and they asked me come into a room. They showed me a leaflet and contined asking more questions. Asking my phone number, calling from their phone to see if I waa giving the right one. Asking who my network provider was. Really bizzare treatment. At the end they told me they stopped me because I was trying to merge with other people whilst passig them. Is it normal to ask details like network provider and then check the number?

I was charge in possession of my van on the 18th of January after falling asleep on the passenger side I had wine and fell asleep I did not drive under the influence however I woke up cold so I turned on the engine to get warm and then I heard a tap on the window.the police had arrived and I was over the recommend limit so I was taken to the police station.i have never been in trouble with them ever in my life and didn't know I did wrong by turning the engine on.they kept me for 15 hrs and I didn't get a call till 12 hrs after I was there.i wasn't treated very nice and was ignored very often after pressing the buzzer for toilet roll as I have chronic ibs and I wasn't fed properly.after finally getting my phone call to my partner who didn't know where I was then released 3 hrs later for him picking me up and telling me that my van had been broken into.all my work stuff had been stolen from my van.nearly 9000 pounds worth.as a result that was caused by the police that arrested me moving my van from where I parked it and not making sure it was locked.we have CCTV from a friends house where they moved it to and the officer getting out and locking the driver side but not any other doors.from then we have two vehicles on the same CCTV pulling up around 3hrs later taking all my equipment.the theft was reported straight away as I returned from station after my detainment and told them the next day we had CCTV of what happened.it took the police over 13 days before they came even though we had footage.we told them we knew the culprits as they live just four doors away.its a complete and utter injustice and not only am I now not working because my stuff was taken I am having to depend on others looking after me and I have worked self employed for over 20 years.so far I have no response to my complaint from the police.i got my justice by loosing my licence and community service so where is my justice for what they did??

My step daughter left home recently under bad circumstances cutting off all contact with the family. She works in the local store where my wife and i have shopped for many years. She has now complained to the police that we are going into the shop to purposely upset and harass her(we have not spoken to her for in excess of a month). We have now received 3 phone calls from the police 'advising' us to not shop there any more or run the risk of being arrested and i have been told i may lpse my job. The officer concerned has told is to drive three miles down the road and shop in other stores. The shop in question is less than one minutes walk from my home and the shop management have no issues with us shopping there. Are the poloce allpwed to do this? Any advice?

Police keep knocking without a warrant wanting to search my house looking for my son's friend. Have not seen this friend in a few years. My son is in the army now. I tell them this and they say they will keep knocking mob handed. They say they have information that he's coming in and out this address. He's never been to my address! Told them to look at the cctv outside my house to check. I can't sleep or relax. I will not let them just come in to check it's a damn cheek.

I wish to blow the whistle on fraud and corruption involving two high profile publicly elected officials, my local council, high ranking police personnel, and a law firm. I have much evidence collated and although I have attempted to contact each individual already I have been ignored and/or dismissed as vexatious or harassed and threatened by police officers who do not seem to exist on any official it's I can find. My human and civil rights have been breached as well as my confidentiality. I believe my online data may also have been accessed. I have requested assistance from various organisations who have all promised to help me, only to withdraw their offer inexplicably within a day or so.
I am frightened, and I have become isolated - something which has been aided by the aforementioned officials - and I fear further retribution. I have been denied assistance that I am legally entitled to, defrauded out of legal aid funding, and denied the right to complain without prejudice or discrimination. I do not know where to go for help, who to trust, or who I can confide in without judgement or retribution. Any advice would be welcome and gratefully received. Thank you.

A raid took place at my home, police did not shout before they started breaking my door in. Once inside one female officer took me into the back room and twice ripped open my dressing gown. I wasn't wearing anything underneath. Threats and shouting me & my son are going to prison !!! I was taken to police station where I told them I suffer from ptsd and was totally ignored. No charges were brought for me & I am now homeless and my ptsd is at a dangerous level where I am struggling with suicidal thoughts. Police were called a few years previously when I was found after a serious suicide attempt. Can they do this? I had fingerprints & swabs taken & entered on to the police database even though I was very against this. They took possessions which were not returned when released without charge or bail conditions. This wrecked my job, I couldn't afford to fix door for 10 days and was an emotional wreck. I am suicidal and don't know how to cope. When an armed robbery took place at some previous address which became the reason for the ptsd in the first place. The cid turned up & the first thing they asked was am I working? Yes I was. Then they came to the conclusion it was an insurance job!!! I wasn't insured. Great crime solving abilities hey? What can I do?

On a journey to work on quiet roads last weekend I and a couple of other cars over took.I in turn over took 3 cars in a 17 mile journey in legal overtaking places (broken white lines), there are no speed cameras and no way of proving what speed any cars were travelling that mornin. Two of the cars I over took turned out to be (and at least one of them is confirmed ), off duty police. The first one didn't take umbrage however the second guy did. After I over took he drove dangerously close to my bumper flashing his lights constantly until after about 0.3-0.5 mile further down road I felt forced to pull over to avoid an incident. At this point he pulled up behind me and started berating my driving. Showed me a badge (with no picture), said he and his colleague are off duty (his 'colleague'also pulled up behind me) Asked for my licence which he then took a photo of on his own phone and then took a photo of the rear of my car told me he'd speak to me later and allowed me on my way.this took a couple of mins. Later I started having doubts, as the nature of his driving seemed aggressive so I phoned 101 to see if it had been logged. It hadn't. By 4pm west mercia phoned me back and told me they suspected it was crime related and to come in to make a statement and to not answer my door to anyone. Well at 10.30pm approx the guy who confronted me in the morning banged on my door (he was alone), now dressed as an officer so I phoned 999 in a panic and he confirmed his collar no. And Was a p.c.He said many things to me in my kitchen I didn't agree with, cautioned me and charged me with inconsiderate/careless driving 'upto' a certain speed which be had previously said was higher. Having a fine points etc isn't what's keeping me awake at night. It's his conduct on the roads. The fact he didnt do any road side checks on my vehicle. No breathalyse test it calling an on duty officer (it was 7.20am) and after implying I'm a danger allowed me on my way within minutes. He Attended my property alone and I have a clean record.

Police officer came to the garage i work and said he wanted access the CCTV.
I explained to him that i have to check with my senior first if they can go to office as we are not allowed to without either the disclosure or any other official request.
He didnt like me saying "please let me talk to my senior first" and said he doesnt need any documentation and didnt want to hear "no".
He said he gives me one minute and will enter the property.
I felt intimidated and was scared.

Felt terribly disrespected as my team saw this happening.

Do they have a right to access cctv like that???

Once i have been with my friends..while the police officer has been taking my brothers details, he said "are yous the ones i have been at your house..." he tried to went on telling why but i over talked him with a "yes,yes,yes,yes,yes..." Until he got the hint and didn't say more. He said that in front of all my friends, is he allowed to do that? Is that not confidential information?

I was stopped by the police and asked for my name, date of birth and address. I voluntarily gave them this information. After a short discussion, I was warned about my behaviour but it was decided that I hadn't committed any offence.

Do the police have the right to retain my personal details on their files? I wasn't arrested or cautioned.

Hi there just a bit of advice please, after leaving a football match with my daughter who was in my arms and is 21month old(who attends the football regularly with me) I shouted towards our team manager with a few swear words with no violence or aggression shown, along with many other disgruntled football fans of my team, suddenly 2 female police officer approached me quickly and one put her hands on my chest and pushed me towards a car where my path was blocked. I asked her to take her hands off me but she continued to push me. She stated in her opinion as a father I was in the wrong and asked for my details and my daughters of which I refused my daughters details, she continued with her colleague to threaten me with action( of which I pointed they had no right as I had committed no crime and was not breaking the law. To say the least it was pretty intimidating and thankfully my daughter was not fazed by it all nor by my shout. Q1) is she because she is a police officer entitled to physical push me with no lawful reasoning? Q2) is she as a police officer able to pass judgment on me as a father. Thanks for any advice. For the matter I gave my name but not my daughters and 15 mins later after a police check was clear I left more disgruntled with the police force than my football team. No action taken" just some friendly advice by the police force" but heavy handed I felt. I just want to know if police offers have the right to push citizens without a cause?

I was coming home through immigration (I have been a UK Passport holder since birth) when, after being cleared at the immigration desk, I was stopped by a female Police Officer (she was standing by a lectern which said Police Scotland, so I assume she was Police rather than immigration).

I was subjected to extremely intrusive questioning: name, address, date of birth, employment, employer, employers address, where I'd been, for how long, the Hotel names where I'd stayed, purpose of my visit, who did I know there, etc. I was given no reason for being questioned and (this is what seriously annoyed me) a record was made in a notebook.

I asked what would happen to the notes she had made and her response was she was obliged to note who's she'd stopped. I repeated that wasn't my question - what would become of the notes she had made. She blanked me and told me to go.

They then telephoned or radioed Customs officers and got them to stop me and search every inch of my luggage. I know this because I got quite annoyed when stopped again and said I'd just been grilled for 10 min utes by the police and one of the Customs officers said "We know". Of course nothing untoward was found and after 45 mins I was able to leave.

My concern is not so much around their right to stop people - my concern is what happens to those notes? I have not been arrested, detained, cautioned, or charged - so what right do the Police have to retain that record. Frankly if they do not have a resonable suspicion that i have done something (which I havent) why should they be able to keep notes on my movements?

Not long ago, my mothers boyfriend and I had a fight over a stupid tv remote. I mean he's the adult here. I wanted to at what films were on as he was watching the football. He turns to the remote as I go to pick it up and he snatches it, mind you I still have my hand on it. We end up fighting over the remote. Mother tried to intervene and stop it but couldn't. I was scared that he was going to go for me so I grabbed his jumper. He told me to get off, I didn't as was scared. So he grabs hold of my arm and twists it right the way round. Then puts my arm right back onto my back. I then end up face down on the sofa. He then verbally shouts and swears at me. He really scared me. He shouldn't of assaulted me like that. I'm a child he's the adult. I need help what to do. Shall I tell the police and get them to have a chat with him do he never does this again. He has anger issues. Should I say something or nothing ??

Recently I purchased a bundle of e cigs off gumtree I spoke to the individual for a few hours every thing checked out seemed legit I'm in the forces he understood I couldn't travel that distance because of work I then paid him via bank transfer he gave me his bank details name address

The police say it's a civil matter surely it comes under theft scam or some thing along them line I've done half the job for them tracking him down the suspect said he sent it asked for proof of receipt then he said he didn't have it and that's good enough for the police it's discusting they would rather help him out moving me on than trying to get justice

About 6 weeks ago two police officers arrived at my door in central Scotland. They had been called by the local NHS mental health team as they were concerned for my wellbeing and safety. I had missed several appointments and hadn't answered the door to my CPN on two occasions. I suffer a major depressive disorder, but this was the first occasion that it escalated to this level; it was extremely frightening.

I was in the middle of taking a shower when they came. I cannot remember the interaction well at all because I was in an incapacitated mental state, very foggy and unable to follow words or ideas. I do however have vague recollections of being asked more than just my name. A male officer wrote things down in his notebook and I now feel very uncomfortable and uneasy as to what kind of questions he was asking me.

I feel I didn't have the capacity to consent to his questioning at that time and wasn't capable of utilising the civil rights I am very well versed in (I have had negative interactions with police when younger, never charged once, and in a professional capacity gained the opportunity to learn about the law).

So thanks for bearing with my essay! Can I go to my local police station and request these notes? What are my rights? Is it possible any of my rights have been broken? This has been bothering me since (now getting much better) and I'd like to pursue it now I have the capability again. Many kind thanks.

I was working with a friend up untill 3 months ago in a small cleaning business . I found out that he did a job behind my back and we consequently parted company .He purchased some equipment for £900 which he made back 6 times and worked only weekends . He has reported me to the police for "stealing " the equipment as I wouldn't take it to his house because of his abusive and threatening behaviour . The police called me demanding I take it to him or I will be arrested , I am now having to take it to the police station this week after abruptly being told by the WPC or I will be arrested if I don't . My brother was recently detained in a cell for 2 days. The reason given was that he had breached the conditions of his bail. However, my brother was not on bail at the time he had already been charged and sentenced for a previous crime ( which is under appeal.) When the police officer was told this he said 'we can discuss that at the station,' took my brother from his home and locked him up for 2 days. Surely this is not allowed?

A police officer can make an arrest and give advice when off duty. The warrant card is simply to identify them as police. In the circumstances, you're lucky the police officer did not call on his colleagues to take more action.

My friend recently received a late night knock at the door from the next door neighbour, who happens to be a police officer. This individual had come to complain about a family member of my friend, who was smoking marijuana in the back garden. The smell was apparently floating in through their back door. They then showed my friend their police badge and said for my friend to do something about it. As a neighbour, I think this officer had a right to complain, but did they break any rules by showing their badge while off duty? Thanks for your help.

I am very confused as when the police officer who had requested the information called me back he ask for my date of birth?! In my line of work I do sometimes speak with the police regarding clients but I have never been asked for my date of birth. Out of the blue in day light, I have been recently psychically attacked and verbally accused by staff attendant of stealing mobile phone from the office staff, while using public toilet at the bus station in Scotland. He forcibly not allowed me to board my bus. He called the police. His intense harassment and persistent accusations lend me to call for help to the driver of the bus and people witnessing it inside the bus to call the police too. Eventually I broke into the bus to keep safely away from that man. Two police officers arrived, and female officer instantly grab my arm ordering and forcing me go with her, which I did not comply with, and politely told her I was wrongly accused by that aggressive man and I stay in the bus. She searched me through and my bag with other male officer, did found nothing. In the meantime the other male office went with that man to his toilet office and after 15min they find the mobile at his toilet office. I did no hear a apology. The police asked me for my data, which I did not comply with initially, so the female office treated me with an arrest if I don't comply. So I did. My question is: Is it my civil right or not, that if I am wrongly accuse and insult, if I do not comply with my personal data being stored in police records (because some mad man has accused me of something which I did not have done), I could be arrested? and he could walk free? What is the enforcement paragraph number mentioned it?

I have recently contacted the police by telephone as I had reason to believe that they had asked a friend about me.
I called them to ask if they need to speak to me or if I was under investigation & they said no.
They said that there was nothing showing up on their system & if there was anything going on it would show up.
They also said that there was no record of anyone visiting my friend at all,let alone visiting to ask questions about me.
They said nobody wanted to speak to me within the force & when I asked if I was under investigation,they said it would show on their system & nothing was showing.
Is this true or could they of been keeping the information from me?

The police recently refused to investigate an organized theft and possible spiking due to my sister being intoxicated. Apparently it was "her own fault" and they cant do anything, despite the people with her stuff having contacted her asking for a ransom (meaning it was clearly a theft). The police know this. My sister is Irish and it happened in England; it seems like she was discriminated against, are the police breaching some civil right by refusing to investigate and take action?

Sorry but we don't have enough information to comment on this. A good solicitor would be able to get this sorted out for you, but may work out costly. A member of the Citizen's Advice Bureau, or your local MP might be able to call the police and put some pressure on. If this is preventing your from obtaining a passport, you might want to make a complaint against the police (try the IPCC).

I have a question in regards to myself being named as a person of interest in a suspected passport fraud from other 10 years ago.
I attended a interview at a passport office in November 2014 with a solicitor and following the outcome of the interview the information was passed to the police in December 2014.
Since after numerous attempts to get this matter cleared up I have submitted SARS request freedom of information request and numerous phone calls to the police to be told different information, from they is no open investigation to they is, to being told they is again.
I have so been told by the police one officer had it and had passed it on another detective but doesn't remember who.
This is increasingly getting frustrating and going nowherr.
I have even recently had a telephone conversation with a detective who actually said well you are the one that commited the crime.
Any suggestions as due to this all currently going on I can't leave the country as refused renewal of passport and I have now been separated from partner for nearly 3 years as she lives in another country.

Are the police breaching my rights or my familys by braying on the door at 4.30 in the morning when they please just to see if i am in ? Is there not a certain time period were this becomes illegal to do so say from 1am-6am?

How long does the Police in the UK have the right to watch you because of an old supposed crime?

In my case I have no convictions, I have never been to prison and I have never to Court. As far as I understand I was only suspected of a crime 18 years ago...

I am currently running my own independent company, and I am afraid that being watched by the Police can seriously hurt my business.

I am just interested in knowing what the law says.

I wont go into to much detail but my query is around the use of tv documentary (police interceptors) footage . My home was filmed as the police searched , a family member was arrested prior to this & I was told this had been filmed too (this was not on the premises & I wasnt present) . I stated I did not want the cameraman to film inside my home,, he told me I couldnt refuse & had some sort of "permission" & carried on . Obviously I dont want any of this footage to be used or my familys story to be aired for the titillation of the viewing public . What can I do about stopping this invasion of my privacy ? I have no idea where to take this ? scared & shaken & grateful for any advise please.

My nephews home was recently raided (to which they came up with nothing). In the process of the bust, they took all mobile phones in the property, whilst I realise the police have a job to do, I was under the usumption that if a person is under 16 years of age he is a minor. Yet the police took his phone. Please can I get some advice on this matter, as it is so unfair & he is devastated. Thankx

You don't really have a choice unfortunately. We suggest you send them again and include a cover letter with copies of the originals plus the recorded delivery information. They should not be threatening you with court action over this though.

I am married and we both live with his mother who'm he shares a mortgage which is still being paid for. He and his mother have been arguing quite alot and an incident happened where she tried to attack him so he defended himself and slapped her across the face, he was mortified and 2 days later she started screaming and shouting at him and she went to the police and told them that he slapped her which is right but she also made a statement saying he beat her up which is a lie on that morning, the fact is is that i was witness that morning and nothing took place, now my husband has been charged for 2 accounts of common assault when it was just a slap across the face. Since then i have just found out that she was diagnosed with onset vascular dementia a year ago and she said to us that she received a letter saying she had no memory problems she was safe to drive her mobility car. Since then my husband and i don't know what to do and we don't know how to get help. His mother has lied on a statement causing my husband to possibly serve time for something he never did.

I was allegedly speeding along a road.
The notification came through and I sent the details required by recorded delivery to the requested station .
I have now been asked to send them again as they have lost them .
They were signed for by the station and I have proof of posting and obviously the post office signature of delivery .
Do I have to send them again as they are demanding and threatening with court action or is it their fault they have lost the details? ??

Our neighbour has dementia but it's only mild.
She's very fit at 90 no aches or pains but,
She goes out daily to her over 60's club, goes shopping, visits family goes bus hopping to get out.
She goes out paying her own bills doesn't have any health issues.
Next door to her we have a drink who turns the communal garden into a beer garden and upto 8 males drink from 3.00pm till 11.00pm most nights.
The trouble is when he's drunk our neighbour bangs on our windows and shouts obsenaties at us and he violently attacked my hubby pug him off workfor 14 weeks.
5he old lady who lives next door to us saw most of these incidents but police say she can't give a statement becauseof the dementia.
The other thing is that she has had more problems with she drunk since before we moved in and had to endure it. So where is her protection and who can she go to who will take her serious.
Her granddaughter whoIves with her has also been threatened and called a pedophile and they regularly say they are going to kill her cat.
We have an injunction preventing him from doing what he's doing.
She has witnessed this but police say they cant take a statement from her.
Where does the law stand on protecting her as they are too scared to speak to police now and won't sit outside when the sun is out for fear of what may happen when all these guys come round drinking.

My question was can police delay responding to a letter before civil action from my solicitor asking for records and statements from the day of the raid. As 2 claims against police are to do with breech in human rights which there is only a 12month minus 1 day from the day rights were breached.

Hi I am after some advice I am currently taking civil action against the police. A armed raid was carried out on my property at 5am on 13/05/2015, (reasons someone anon said that my eldest 21yrs at the time had a gun and amo, he didn't the only thing found was a legal air riffle) which police later tried to return to my peoperty. There was aprox 2 van armed response (full kit helmets, guns, tazars, shields the lot and then aprox 10-15 p.c's. Police smashed Dr off but never entered property instead kettled my front door, screaming my eldest name. I have never had any dealings with police before in my (then) 38yrs of life, so this was extremely scary, and intimidating, especially as my other 3 children ages at time 4yrs, 10yrs, and 15yrs, my partner and my eldest's girlfriend were also in the property. I was only wearing vest top and thong as just woke up to shouting, so police could see I was not armed, told me to get everyone else up and out so my partner carried our 4yr old daughter down stairs, with sights from tasers on both of them, they were allowed straight out, my other 2 sons and myself came down stairs and went to follow my partner with my son's close to me as I went to go out door police shoved me back into the property with shield to my head. My eldest came down stairs followed by his G.F he had his hands up, and was saying I comply, I comply, I am not resisting, police told him to stop on bottom stair and turn round so his back was towards front door, they then deployed taser twice into his back. At this point myself and my other 2boys were screaming for help and to let us out next thing I knew they tasered myself once to my nippel (barb was deeply embedded into actual nipple) & the 2nd hit my public area. I rember screaming and hitting the floor. My son's were made to step over myself whilst still been taserd , and my 15yrs old who has mental health issues, was placed in cuffs ,behind his back for over an hour even though police were told his age. Police took myself and my eldest over 9miles to steel house Lane police station ( I had no coat and no shoes or socks on) we both still had taser embedded in us, police stain refused us, as needed hop to remove barbs, was taken city hop made to walk car park, n hop corrie doors, with no shoes etc. Once barbs were removed we were took back to shl police station, and even though I have never been known to police, & the raid and search of my property (without my knowledge) was over before 10am ( my partner was there), we were detained for over 9 and a half hour's last time I had seen my babies I was lying on floor with 50,000 kw going through my body, I had not had a phone call as didn't have my mobile and didn't know any numbers 5 times I asked for them to let either my partner or my parents know where I was. A friend of mine was taken to the police station and kept in a cell for a few hours then taken for questioning because a family member has accused her of theft from her mother's bank account (her mum has dementia) my friend has told the police that yes she had used her mum's bank card to lift money to purchase food or anything else her mum needed, but has stated that she never used the card without her mother's consent, she was charged with theft, with no proof that any money's had been taken fraudulently, she know awaits her court date? How can they charge her with theft like that?

I don't think my kids are at risk from my ex wife's partner but more the case of him bringing trouble to their house i.e they've had people come round to the house and threatening texts (due to them selling things, what things I don't know?) also trouble with people near where they live and trouble with where he works (which by the sounds of it seems like dodgy jobs).
The kids hear and pick up things and also have seen the police around their house alot but when I ask my ex she hardly says anything or plays it down so im being kept in the dark which is why it's even more worrying and on my mind.

They don't have to give you information. You've not told us what kind of incidents these are. What have your children told you? Do you have reason to believe they are at risk or that they are witnessing something they shouldn't etc? You could contemplate asking your ex if she will consider contact with the children when her partner is out etc? A prohibited steps order etc?

My kids (8 & 12) live with me most of the time but spend odd days or weekends at their mums house, their mum has been with her partner for about 2 years but in that time the police have been called to her house on 7-8 occasions about various incidents (having been informed by my kids or their neighbours) worried about this I contacted my local police but they refused to give me any information and just said that if they thought the kids were at any risk then they would approach a welfare officer first???? surely as a parent I have every right to have information of what is going on in that house.

The police recently done a raid at my relatives house and I turned up to the premises during it. The officer there told me it was due to information found at a previous raid. They told my relative when they interviewed him under caution that it was an anonymous tip off. They have clearly lied to one of us. Are they allowed to do this.

Hi my friend was assaulted by her husband battered her broke her nose and other damages to her face,i was under the influence of alcohol when I was told about this and found out that his boss wasn't caring and therefore let him continue to work in the private school as a chef,I called the school and left a pretty upset message about the whole thing,I didn't make any threats well I maybe made in saying I'll go to the papers if he continues to work there,I was upset and angry I wouldn't really go to the papers,the police have been calling my mobile and hammering at my door do I need to answer the door? When I asked him reason, he said because of his grand ma's illness we are going back. But after that he took all my things clothes, laptop, BRP everything and left to London next day. I was arrested for assault because my phone was found at the scene and now I've been arrested even thou I reported the phone stolen . They have applied to the court to make me hand my PIN number over and they got permission to do it, but I don't know the code any more so I don't know what will happen

1 night last year I had as whats described as a nervous breakdown.i was crying and shacking uncontrollably. Working hard all my life like most.but found myself having to live in my car.the car didn't work and hadn't been driven. I said im sorry I feel stupid.saying to me ive done the right thing.1 officer said I mentioned a car in my call.i said yes sir and pointed to were the car was as had nothing to hide.he wslked off to look. I carried on talking to the pcso ladie. Still crying shacking but starting to feel better out of no were the other officer with out my knowledge just threw himself at me I saw him last second and just stepped foward out of the way.looking at the pcso.he shouted evading arrest and assualt.i believe he fell over as I moved. I could not believe this I begged whats going on totally confused I went to my knees and said im not whats happening pls Im scarred he then kneed me in the chest breaking my ribs punching me in the face and bending my arm so far up my back and smashing it. The cams they wore that ive seen do not show what really happened the pcso who videod this wrote in her statment I was unaware and this was ripped infront of me they used partial parts of this and used another officer to take her place in the statment. Losing the pcso all together as if she wasn't there. In van van realising I called then for help and my car wasn't working infront of me made excuses for the blood on my face cuts and ribs.saying I refused a breath test and went down the suspions of route.whilst listening to them excuses made ip infront of me in dispaleafe I picked up on them saying things aboyt human rights Geneva and pace rules I then sais well if that means that then this means this the van stopped immedeatly then my life really changed every 1 told to get out as what I said was right.being asked to I study law etc.5 minutes later a women enterd sayingI could trust her do I trust her.saying what I said was a matter if nnational security. I had to trust her I was so scarred and alone..they interrlgated told id been hypnotised me forhours being rushed to hhospital from the station so so so much happend. Ive not slept eat properly for a year now.they told me I would be shot if I remember wgat I said and told me they will make me guilty. And this will send me mad and probably kill myself. The police are acutely aware of the problems of domestic abuse and will usually do their utmost to resolve issues and bring perpetrators to justice. If a witness warrant has been issued, this means that you are required to cooperate.

Whilst filming a police sergeant behaving badly to drivers at the scene of a RTA, (he was screaming abuse at them), he saw me filming and lied to get me to stop, first he said I could be arrested as I was interfering with a crime scene, No Cordon etc, I said I wasn't. He then said I was causing an obstruction, the road was blocked with a police van so no obstruction to him. He then said that I was a danger to myself and the road users, I again said I am safe, I am a journalist and member of the NUJ.

He assaulted me, then I was handcuffed, my phone confiscated.

I was not given a police caution although I was told I was arrested under sec 5 POA.

I was only filming.

Question 1

Can the police use Pace section 19 in the street as lawful reason to confiscate my phone?

Question 2

Police using false excuses by quoting various laws that do not apply does this amount to misconduct in public office?

Question 3

Police handcuffed me very tightly, ignoring the fact that I had a cannula in my wrist, As I did not present a flight risk, I was smaller than the 3 officers, very sick with a burst appendix and septicemia, Would this be breach of my rights as it conflicts with the Met Police guidelines for the use of handcuffs?

Question 4 preamble:

Police then put me in a long wheelbase van handcuffed in the rear, the driver drove like a madman, slamming brakes, crossing onto oncoming traffic etc.,

I was unsecured in the rear of the van, and was thrown backward and forwards..

Question 4 Can this journey be considered assault?

Question 5 preamble.

At Hammersmith Police Station, I was kept shivering in very low temperatures handcuffed for twenty plus minutes, I complained about being ill, and being very cold, It made no difference

Question 5 To what extent does this treatment amount to assault?

Finally, I was bailed, and I asked to leave, after the roughing up of the police, the overtight handcuffs and the nightmare journey in the police van, I had no desire to go with them.

They refused, stating that they had a duty of care, (didn't show much earlier), they must have finally taken on board I was going to sue them. They made me go back to the hospital and frog-marched me into the ward and then had a private conversation with the nurse, when I tried to listen in to the conversation I was threatened with re-arrest.

I am currently going through hell with the police over a domestic disturbance in my home 6 months ago. I retracted my statement but they are now trying to serve me a witness warrant and are at my door numerous times a day. This is making me very ill. I am no longer with my partner and feel very threatened when men are hammering on my door at night. Usually plain clothed. Do I have to answer the door and between what times are they allowed to come to my home? I work full time and can barely sleep as it is. The court case is next week and I'm hoping without my evidence it will be thrown out. I can't understand why it has gone this far in the first place since there was no assault just shouting. I know never to call them again. Even witness support has threatened me.

Hi please help , my son was arrest at a pub and was very drunk and incapable. He was arrest in the evening at 9.30 pm and released the following day at 7.30pm. He was charged with harassment which l find very odd because he was very drunk and unaware of his actions because he was Very intoxicated to the extent of losing control over normal physical and mental functions. He was also accused of racial abuse but these two charges were not bought against him which l find odd also there was a mention of CCTV if this was the case would the police have to have shown this to my son in the interview? He did not have a solicitor present and he was offered one. My son has never been in trouble before , he is 22 years of ages and l feel that he may have lulled into a false sense of security just to get out of the police station. Can you please advise and also if the police had CCTV should he have been shown this has it would be evidence. Thank you

I did something stupid I pulled up on the hard shoulder of a motorway and crossed over it for work related reasons (photographer). Police charged me gave me 3 points for parking on hard shoulder of motorway awaiting outcome for walking over motorway when it was terribly quiet. One officer decided to make an example of me by talking to me with a raised voice and reading the riot act. He said he could have got me put in a police cell over the weekend 2 days if he wanted it was his discretion. I got let go just was completely traumatized from it all as I was made to feel pretty bad. I understood I broke the law but this policeman was incensed, it has really made me quite nervous about driving on the motorway. Doe anybody heard about this procedure holding you in a police cell for 2 days for walking over the motorway.

The police aren't interested in the truth or justice, they don't protect the decent and innocent of this world they ALWAYS take care of the criminals. My family have been through hell and we are still going through hell,my father was falsely accused of horrible crimes just so that the criminals had grounds for appeal to try and get a brutal killer out of jail and her family backed her up,the police put us through hell turning up when they felt like it.My dad was sent to prison because his defence team didn't call any defence witnesses of which there were 10.Now he's out after 9 months pending his appeal and the police are still harassing us,the crown star witness admitted lying in court,the judge was a joke and couldn't run a raffle let alone a court even allowing the liars to shout and roll on the floor of the court,my dad has dementia and Alzheimer's and his family weren't allowed into court as it was a closed court. All of the crown witnesses lied therefore commiting perjury and the crown has done nothing about it.My dad's human rights were breached so many times. Now I myself am a victim at the hands of the same liars who put my dad through hell.I've been charged with sending a malicious message via social media and have been to court twice so far and I'm back there twice more in the next 3 weeks.The police weren't interested in what I had to say,they refused to take my mobile and my laptop instead telling me that I was being charged one way or another in other words they had predetermined the outcome of the questioning that I was to be put through. I gave a no comment interview, they were extremely annoyed at this and said that I had admitted sending the message, which I didn't as I'm not stupid.The police are good friends of the criminals that are doing this to my family so what chance do we have of justice the police are corrupt. The same criminals had their friends the police give me a beating outside my parents house in 2009,I sustained 3 broken ribs,concussion, shock and now suffer from PTSD.I've never broken the law in my life but the police are determined to make sure that I get a criminal record before I die.The criminals responsible for our hell sent distressing messages and a picture of my terminally ill Mother to me the night before my Father was convicted and the police refused to do anything about it.My Dad is INNOCENT and I am INNOCENT we live by the law and the police are unrelenting in their pursuit of putting us into jail. Police will arrest you just cause they feel like it, they pick and choose who they arrest..
I was harrassed by some fat chav for months, not once did the police arrest her and claimed i was pulling the race card but moment she accuses with with no proof they want to arrest me.

Recently my parents visited me in uk for family visit visa and they are both above 65 years of age. They are both coming to UK from last 4 years and spend 4-5 months with us to see there children and grand children. They left 2 weeks back and yesterday police came to my home and asking were your father here and I said both my parents were here and now they have left . My parents are too old and stayed with me through out there time and a regular uk visitor. Father is a retired officer and well educated. Since our childhood i have not had an interaction with police and more importantly police knocking on my door. I gave all the contact number and details to them as they were asking but I am completely stressed that why would they come to my home at first place ? 2nd why would they ask about my parents who are decent, pious and old people. We are hard working , tax payer people and I can't imagine in my wildest dreams police knocking on door. When I talked with my parents on phone did anything happend while you were here and they said nothing . I don't understand why someone would come to my home and ask about my parents. Though I have answered there questions I.e. Address of my parents outside uk, contact number and all details however I would like to know what it is all about ? And why would they drag someone working hard and living legitimately into something which we have nothing to deal with ??? What are my rights in this case, I would like to know what's going on and why they came to my home at 1st place ?

police have destroyed my career, reputation & health. Failed to deal with a rapist who made malicious allegations against me to thwart a rape case - it worked. I have been humiliated & vilified for 14 years. They continue to play mind games. the rapist & police's lies are even written as fact in MY medical records. I am now destroying my own body as I cannot take any more. I no longer trust anyone.

I have been medically ill for a number of years now due to a police officer selling an untrue story about me to two newspapers, it ruined my modelling career and my job at the Bank of Scotland. This was a very serious position for the Metropolitan Police, I was on a poster in every police station in the country for the Police Federation campaigning for more ethnic minorities to join the Police Union because the numbers were low and they did not believe they were be treated fairly. The IPCC, Thames Valley police refuse to admit and expose this officer for him to be held to account, the article states the office informed the Police Federation when he saw the poster and the Federation removed my picture, my life has been ruined even with the help of my MP the cover up continues and I am not the same man and on constant medication. How are the police allowed to get away with ruining some one's life and making money from news papers, I am 48 years old and was in trouble with the law 28 years ago as a youth for shop lifting and changed my life around wanting to give back to society. I was plastered over the papers as a convicted mugger and street robber, my family disowned me. Please help with advise of some one I can talk to.

A family friend and mate were in they're car outside the mates house when 2 police cars pulled up one behind the other along side them and the first car asked the some questions about a car that had been vandalized the 2 mates answered the questions and the first cop car drove off. The second car then drove up along side them and asked the same questions and the 2 mates questioned the police officers about what was going on and stuff (probably being a bit cheeky) so the officers got out and started checking the car over to see if it had anything wrong tyres, lights that kind of thing . they then noticed that the driver was wearing a badge thing that said he worked for the local council so they asked for his license and said we could write a letter to your work . so they did apparently exaggerating stuff and getting the lad put on probation at work yet he hasn't heard or been charged by the police can they do this .

Jim first and foremost calm down the landlord ask you to leave the property because of rent arrears, I presumed to pay a deposit through a letting agency and any damage or broken items would be charged to your deposit, you also should have sign a letting agreement and the letting agency should have received the keys and gone through all the items which were in the property and on the check list as the police have asked you to attend the police station first thing you should ask is 1 are you being charge 2 do you need a solicitor if the answer to any of these is yes then you can get any solicitor free of charge to attend with you when you go if the answer is no then it seems the landlord has made an allegation against you which of course you can challenge over the phone.

Hello there, I recently was given eviction from my flat due to rent arrears as I was made redundant. In leaving my house I was moving to my friends house and left my new fridge freezer in the flat for the new tenant. I left the landlords keys in the letter holder as she didn't show to meet me and I left ( with a friend ) she didn't show for 3 days to get the keys, while the removal men met me at my friends house with the furniture I then recently received a phone call from the police asking me the wear about a of her washing machine. It was left in the flat... Along beside the cooker and fridge which belonged to me, the police have asked me to go in and answer some questions this is precoshinary. I need help because they live in a different area from me can they come to my home and question me as they're based a while away, also I am worried as I do not have a clue what to expect I have never been on any bother with the law my whole life? Lettle own set foot in a police station...

GB my initials first name Gary anyway, Mockingbird be very careful when dealing with the police, if I were you I would seek the advice of a solicitor, if you were asked to attend an interview at the police station one would be provided free of charge, I take it you were never invited to attend an interview but instead were warned off, if no action was taken against you then leave it I would for sure, as there will be nothing recorded against you and it will all be forgotten about very quickly, seems this man made quite an impact on you the sooner you forget him the better for you,

But again we have a saying in this country "Leave well alone"

Mockingbird don't give the Police the power to arrest you best thing you can do is to leave this man alone and forget him while it suited him to text you in the past and flirt with you means he should have given you a reason why he did not wish to continue talking to you, however go out and meet people online even anything where you can make friends.

Thanks for your comments they are appreciated, yes it was a solicitor who told me it was the wrong decision to accept the caution and therefore a mistake, but I'm a 60 year old man and was confused.
my case has been sent to the special case unit at New Scotland Yard but to be honest I'm not expecting anything as I feel this is something the Police want to keep covered up to protect this officer

the fact that a senior Police officer from the same Police station has issued a correction letter to your employer is proof that the officer lied, this must have really hurt as its likely that the officer who had written the correction letter knew the officer responsible,
I feel for you as the officer has had action recorded against him which again is proof that all is not right here and should be looked at again, when you say it was a mistake I take that as you have been in touch with a solicitor who has advised you of this.
If the Police know of any officer who has lied this must be reported and action must be taken against the officer it is the duty of the police to see that this happens and to protect the public, I cannot understand why this has not been done they you still suffer.

I got a warning for harrassment by the police. I texted and left voice messages to a man I used to know but had not a relationship with. He never replied except once when he threatened me to call the police if I did not stop. Unfortunately I could not - I don't have one single friend and I am obsessive compulsive it seems. The texts were always friendly, sometimed tearful. The man indeed went to the police who listened to my messages and issued the warning. Nobody askef me about my side of the story or whether I had anything to say. I don't have a criminal record, they say, but if I write to the man once more, I will be arrested. Were my civil rights violated? I feel my personal rights were violated. The man only flirtef with me, that is all that happened between us, then we parted without good bye (his decision). What is important is that this man communicates by not answering his phone but listening to his voice messages. That is how we communicated while I knew him and back then he did not say he minded. Also he started the flirting though it was more of a work relationship. And now he based his shutting me out on the fact that we don't work together anymore.

when the system fails.it fails all of us!this is what police and the district attorney can do to us if they want to and if you dont have money to fight it your going to prison.few months back. my son was arrested on charges made by three drug additcs.on there statement alone.the police were after my son for long time becos they would stop him and search for drug"s and bring out dog:s to look but never found any.these three drug additics my son had dealing"s with the one work"s at a thrift store warehose were he steals jewlery and other things to support his habit.one day i was siting in my computer room when my son came up the step"s stateing that mike was calling the cop"s on him . so about 10 minuites go by and here comes the cops so i go down and open the door ask if i could help them . they ask were"s your son he was siting watching tv so they came in and one ask me did my son go any were i hadnt seen him leave so i saied no. so the police were talking with him and about half hour goes by here comes this cop with grin from ear to ear he came in and told my son stand up and put cuffs on him saying your under arrest. we both ask for what ! burglery. the smileing cop saied .well they take him off to jail and we cant find out anything other than the three drug additics was one's had him arrested. so next day my son call:s from jail and say"s if they ask for any thing give it to them so we told him no we would not and we wanted no part of them !next day my son call"s and say"s three more charge"s on him trying to bribe witness the cop that smile from ear to ear waited all night for my son to make call so he could use any thing for more charges so we tryed to talk with his public defender but he never would call us back we had information to help my son"s case my son"s g f was at the tralier park were so called crime happened talking with her friend"s when the women addict came walking up and ask her if they could talk.few days before this mike the leader of them tryed to get her come there .so she saied ok she would come talk with them .there was five people standing there when the drug additic ask her to go there .when they got there mike and other drug additic was there and they started saying to her that they didnt want him arrested but the police told them to file charges or they would be problems for them .so my son"s gf ask if it was ok to tape what they were talking about all saied yes so they told her how the cops sit on there couch and laughted about how they made phoney charge"s to arrest him so after they were done talking and told her bunch stuff she left .well about two hourS later mike starts calling her threating if she didnt meet with him and get drug"s he would tell judge to give my son max sentence she did not answer him back so few days later we talk with my son on phone and he says district attorney saied if he didnt take plea that he would start arresting his familey .and they did they a

Iv just found out iv to be charged with a breach of the peace after an altercation outside
which happened on 17th june. i just found this out a couple of days ago after a call from a police officer who still hasn't arrived to arrest me yet even though iv spoke to him on the phone twice. is this right? are the police allowed to charge me after this amount of time especially if they have known about this for just over four months & had all my contact details???

It would depend on the amount you were growing and whether it was deemed to be for private use. New definitive drugs guideline comes into place on 27 February 2012 which gives details of the relevant amounts and action. There is an overview of this on the Crown Prosecution Service website.

Last week i was in my bed wide awake light on and lit a cigarrette so opened my window 2 inches it was 4.45 in the morning. I heard a tap and turned round and a man with a balaclava had jumped into my widow soace and was about to put his foot on my bedroom floor. i screamed hysterically as i went toe=wards him screaming all the time, he hesitated, i did not take my eyes off his eyes, eventually after what seemed an age but was probably only a few seconds, he disappeared.Still screaming hysterically i ran around my flat eventiually phoning the police. The man was tagged and should have been home. Can I sue the police for compensation?

My husband gets stopped by the police few times a week if he's out late around 1 to 2am. They stop him for 'routine check' apparantly. He comes home many hours later because they take so long and make him wait. Are they allowed to do that?

Basically I met my gf online over 4 months ago we have spoken and met a few times she is 17 im 33 it's a gay relationship. She made a decision to live with me as she was just so much happier. So I supported it her parents dislike me and won't give her a chance to explain anything. So she wrote a note and left home which by law she can do (we both checked before) I collected her and her mum called she answered and told her mum she was happy and it was her choice to leave and that she would be back to see them in a few weeks and that she'd message them everyday and that she was safe. They still called the police and they came and removed her, her parents have given the impression I'm a bad person and that she was in danger. She was high risk missing person as she has never left home before. She went home and her parents have since cut her off by taking her phone and making her delete her fb and stopped all contact with me. She wants to leave again but is worried she will.be returned home which neither of us want. I have no criminal history of anything. So would she still.be high risk? Even if she called the police and told them she is not missing

I beleive a wrong decisions have been made unfairly by Psni officers whos names for now il keep to myself

I believe this officer let me down with my report i made to psni via a distressed phone call.
I beleive the evidence i produced was strong enough for a convction against the person/s i was being severely harassed by.
Also at the same time of this incident this officer was investigating a seperate incident against me by my Harasser.
I would like to know how i go about getting these two cases thouroughly investigated and decisions to be made fairly.
Also the other investigating officers have close links with the people who our publicly harassing me, including my harassers these othet people who harass me our also psni officers.

Hope you can help me, or advise me on what route to take regarding appealing or challenging the decisions made against me by these officers.

Yesterday around 19:30 in the evening two policemen came banging on our door and window. They said someone placed a distress call from our house mentioning our address. They came in to check the inside of the house and ask me who lives in the house, told them its just me my husband and my son. I told them if they would like to go upstairs as well as we live in a maisonette so they went and check but saw them leave a few moments. Around 20:00 someone knock on our door again and 4 policemen were outside. My son open the door and told me the same thing that someone placed a distress call and gave our address. Is there a possibility that someone is prank calling ang giving our address?because of that i did not managed to sleep a wink and feel very stress of what happen. Is there a way to find out who might be the caller?

Hi, i really need done advise. Their was an accident at the end of my Road which i coule see from the other end where i driving. Their was a police at the behinning of the Road with signal on in a corner. Two policemen where in the car. I made my way in the road and waited at the back of the police car as i could see am ambulance coming towards my way. One of the police officer came out telling me that i cannot go through which was logical and i understood. I was trying to explain to him that i am just going 2 houses down and got a driveway which Will be far away from the accident scene but he started raising his voice tone not even listening to what i was trying to say. He started intimidating me saying things Like i tell you what to do. I replied to him saying that you should not be speaking to a member of the public this way and not shouting. Again asked him his number and he walked to his car, his colleague came out and asked me to get out of my car, invading my personnalise Space putting his head through my Windows. He tried to grab my hand which i was not having, telling him not to Touch me. I got out of the car, the First officer came with a booklet. He asked me for ID, i say why? What did i do? I then heard one of then saying get in the police car, i was shocked and saw a member of the public on the road asking him to Come and bare witness what was happening. I then gave the police officer my ID and the other Guy was trying to ask the policeman about what did i do. The police office told him you dont need to know and was trying to intimidate him to get him away. I have had trouble with the postman, to cut a long story short he has made false assault alergations and our post has been stopped for other 3 weeks now without any notification whatsoever. I have had no contact with this postman. Today (3 weeks later) two police officers came round my house in plain clothes with no notepads or such...unfortunately I was not in but they left a message with one of my house mates, that read: "please contact ----- police station, ask to speak to pc -----" they also pretty much let them selfs in my house and had a snoop around aswell whilst asking personal details about my self to my house mate, which I am extremely annoyed about. I phoned this number and when I was put through to the pc in question it was voice mail, I am fairy certain these officer's were off duty, are they aloud to act this way? And what should I do? Im willing to pursue legal action against royal mail if need be.

as part of my job I visited a client with a view to obtain signatures from him re a pension review. 2 police officers appeared from a side room & began questioning me why I was there as previously the client was part of a fraud scam. I was taken aback & felt quite intimidated as I was there solely on a prearranged business meeting. The police seized papers from my company with no receipt. My friend (angry and upset) exercised his right to perform a citizens arrest and detained the lad until Police arrived, after the Police arrived they informed my friend that he could be arrested for 'common assault' as he has no powers to perform this arrest.

Hello, I'm extremely worried and need some advice, November last year I was called in to the local police station for a voluntary interview regarding an issue relating to my previous job. For the last 3years I was a domicilary care worker, I've been working as a carer for the past 10 years. In September I was dissmissed for gross misconduct, I was accused for not attending a call but apparently writing to say I did attend it, this is nonsense I'm innocent. I've not done anything untoward I'm a caring genuine person, the police issued me with a caution which I refused I then was allowed to leave with no change the police officer said agrilly that he would be in touch. Today I received a phone call because that police officer wants to see me regarding the same issue he said he can come to me he's said that cps have said to offer me that caution they tried to give me 6 months ago or go to court I'm so confused why contact me 6 month later I thought it was dealt with he's seeing me on Wednesday I'm not changing my statement so do I tell him to start court proceedings I don't know what to do please can I have some advice thanks daniella

Hi, I got pulled over in my vehicle doing NOTHING wrong - I was on the way to an animal rights gathering, although the police would not have known this. The gathering was in a field next to the road I was driving down. I did not display that I was going to this gathering. I was stopped told to get out of my vehicle, and stand in front of it. I was asked if the vehicle was mine, I was asked if I could produce evidence of this and was asked my name and address. At the time, I was livid and I kept saying I dont really want to give my details as i dont know what ive been stopped for. They took photos of me and my passenger and the inside of my vehicle. If this happens again, what rights do I have? I cant remember now the reason they gave for pulling me over - it was several years ago, but this sort of thing could quite reasonably happen to me again. Thanks

There are some security measures in place to ensure that policemen and their families are protected and also that police officers cannot be connected to anything that would affect local or national security. They're not carried out to the extent where they would affect your civil liberties.

My boyfriend is a policeman and sometimes he tells me strange things like: "when your daughter has a boyfriend i need to know if he is known to the police" or "when we get married they will make q search on your name" or "they know everything about you and people attached to you, mum, dad, kids, etc." not that i have anything to worry about but i just think this is to much. I don't know if he is doing this to get control over me or something else. He is my boyfriend for 3 years and sometimes he comes up with this conversation out of no nowhere. Can you please tell me my rights in this situation as I am getting really upset with this situation. @Boo. Police officers are not supposed use their work 'equipment or knowledge' for private purposes so it would have to be an official enquiry. Incidentally, anyone can find out information about whether a vehicle has been taxed or not/ or is under SORN by doing an internet search.

About 6 months ago, I parked my car on a hill, and visited my friends house. My car rolled down the hill about 8 feet and was resting against another car, the police were called as I was not present, the police then procedeed to get my details from their database (I would presume) and called me to attend the scene of the incident. The owner of the second car and I agreed to settle things without going through insurance policies, in a civil and polite way. The policeman in attendance was happy with this and left us to come to an agreement. We came to an agreement, then 4 months later he finally got his car fixed at my friends garage, my friend billed me as I said I would obviously pay any damages. Now the owner or the 2nd car is trying to get more money out of me, and has supposedly rang and spoken to the officer in attendance on the night, who has advised him to give me 7days notice to pay. Is this warranted, and can the police even get involved if he was happy for us to settle the matter civilly.

Hi looking for advice. the police American to my house looking for my partners brother. we refused to let them search as this has bn going on for almost ten years. overtime he's out jail and something goes down they searchy house n never find him because he isn't there! So we said that without a search warrant they weren't getting access to which they replied that when they get search warrant they will break my door down which ill have to replace they'd arrest my partner and involve social work. we let them in because we were scared. they found nothing! A friend of mine was assaulted by two men outside a public bar he fought back and injured one of them. I was arrested for assault on a man which is my nxt door neighbour. The police were called by my neighbour. Two female coppers used Excessive Force while hand cuffing me. They used Two sets of Handcuffs?? The Handcuffs where so tight I was in agony. I told them that they were to tight. But they didn't loosen. I was then taken to the floor and held down. I have got nerve damage to my right hand. I am also covered in bruises and cuts to my wrists and to my body.. I have just got back from the hospital as my doctor suspected I had a Scaphoid Fracture. Xray was taken & there wasn't any fractures. But do have Handcuff Neuropathy. I am disgusted by the way I was treated by the police.. I know I broke the law. But i do have human rights.. I am battered & bruised all over my body. I want to take action against the police. I don't know how or if I can do this?

Today I was knock put down on the floor of a Lidl supermarket by the security guard. All because he has been rude to me and I have asked for his name. He refused to give me his name and I ask to see the manager. He told me the manager was not there. I told him to let me see his name on his arm band and he took it off. As I was taking a picture of him he told me if you take a picture of me I break you phone. As I was trying to take a picture of him he grabbed my arm and push me down the floor. I was shouting to call the police and he throw me out the store.
I called the police and wait for people to come out the store. as they came out I asked few to witness. I managed to convince one. When the police arrived I ask them to look at the CCTV footage. Of course inside they told the police that cctv footage cannot be accessed because there was no one to operate the machine (or because they want hide something?) I have stressed the police to check for this footage (as CCTV don't lie).
I am an honest citizen that cannot accept to be treated as a criminal.
What can I do now please?

6weeks ago I was at a friends house and the police came knocking for her son they took my details I didn't think anything of it, but a few weeks later about 6 officers came to my door banging loudly and searched my address when they found he wasn't there they went didn't think anything, then two weeks after that cid banged at my door shouting open the door at the time I wasn't in it was my mum who was looking after my daughter accusing me of being my friends son bf which I prevesly told the officers before I wasnt, my mum suffers from mental health and they kept askin her questions askin why she's so nevous and it looks like she has something to hide when as well she had a car crash a week ago. Is there any thing I can do to stop them turning up uninvited I feel like I can't have my daughters friends over or guests because I feel they are going to turn up every week.

My partner and I was enjoying a few drink at her house to celebrate my birthday, my partner had put her son to bed so we settled down in front of the to. We fell asleep
We awoke a few hours later to find her 2 year old son had vanished, absolutely panicked we called the police and I went looking for him. I returned to be arrested with child neglect, they have told us we can not be together and have taken my partners kids away. They are our world. We are both in a bad place and need some help

my partner was arrested for a domestic incident and although i am not pressing charges he has admitted in a police interview to pushing me onto the bed and briefly holding me down during a heated argument, he has been charged with assault by beating and has been bailed to attend a court date in 6 weeks with the conditions that we dont have any contact and he is not to be in the place i am currently residing (although they gave no literature to support this??). as he is the named tenant in the place we rent and neither of us have realisticly got anywhere else to stay and he needs to be at the address for work the police told me i am now homeless so have been staying in a temporary night shelter mainly for ex offenders which is horrible, i have to vacate the premises each day and return of an evening, we both want to put this whole thing behind us and obviously feel i would be much safer back at home, will the police return to the address to check we are not together as i don't want him to be dragged away again and in more trouble

My best mate has stopped her ex seeing their son because he has a drug addiction.. A few month back he turned up at her house kicking off and she reported it to the police the same day his new gf reported him to the police for keying her car and smashing her wing mirror. Now because my friend has gone CSa he has to pay her 45 a week he's still with his gf and they are having a baby.. Months later now he has to pay CSa they have reported my friend saying she keyed the car and that I drove her and they have gavey reg and now the police want me to go to the station to be questioned why would this happen when I haven't done anything not has my friend .. It's just that I was on the net getting some info and I noticed there that I should've been given the statement to read and if I couldn't read it then the policeman should've read it back to me before asking me to sign it. But he just asked me to sign it.

I gave a statement at the police station about my husband, I asked for a warning to be given and I was advices of the procedure but told at the end that it's more likely he will be given a warning this time but now he's been relised on bail conditions, charged with a court case!
Also when I gave the statement it wasn't given to me to read and it wasn't read back to me, I was just asked to sign it. I have heard things about my statement which I never said what does this mean? Why wasn't I given my statement to read?

One of the witnesses expressed concerns about whether the things were actually in there before I went on holiday as I was arrested on my return. They have changed their story at the second interview to say some things were handed to them now. What do I do?

@lainchers. This warning was probably given as safety advice rather than as an order to your friend. The police have limited resources so probably could not be expected to have to deal with any repercussions of a visit to someone who lives near the perpetrator.

A friend of mine has had nearly a year of problems from the ex and the cops did very little to stop him. A police inspector told HER not to go to see a friend who works next door to where her EX works other wise SHE would be arrested. In other words this inspector has banned her from seeing her friend because her ex works next door to him. My question is has this inspector got the right or the power to stop her going to see her friend, or can this only be done by a magestrate in the form of some kind of Court order. Surely its her human right to go and see her friend if she wishes to do so and I think this Inspector has no such power to stop her doing so in his own right. The inspector told her she is not to put herself ,'In the firing line'. Her ex has walked away free from a load of charges and complaints about her ex because the police said he was not breaking the law even though he has harassed and intimidated her for the whole of this time. I think this is a disgusting breach of her quality of life and her human rights.
I eagerly await your comments and advice.

Have just found out my 13 year old daughter has been questioned in school today without me being notified and without a guardian being presant through the whole interview she has come home in a terrible state as he was making threats about prison even though she was a witness in a fight.is this against her civil rights and are the school and police aloud to do this without notifying me?

I was a victim of crime in county durham , the police says they have interviewed the suspects and they also have 2 testimonies from neighbours who saw the same guy I did do I have the right to know the names of the suspects? the police has said they cant tell me who they are ...should they be showing me their pictures or faces so I can recognize them?

7 weeks ago my old neighbour was burgled. He walked in on the perpetrators, who fled. No harm came to him. I was with my partner at the time, 50 miles away. my mother is his neighbour and she wasn't there. 2 weeks later I came back to my mothers to cut my her trees. The neighbour who is 82, called the police thinking it was an intruder. My mother explained to the police that it was her son and he was cutting the trees. The police officers could see I was doing this, and were satisfied. This was reported at the police station. Today a police officer visited my old address again and told my mother that my "name" had been mentioned in relation to the crime, and that they would like me to come to the station. I called the officer and told him that I was with someone, that I have no criminal record. I asked him who said my name. [but I don't hang in criminal circles and don't have a record] He wouldn't answer that and said that if I didn't come to the station he would put a call out to have me arrested anywhere I might be, that would mean that the police could search various family members places and that I would be brought to him. He never specifically said "arrest warrant."

My impression is that he now has my name because I'm registered at the old address and the neighbour got spooked when I was cutting the trees.

I have no intention of traveling all the way back just to provide a statement. I'm under the impression that the officer is just following any lead and trying to clear his paper work but I'm not an expect.

PS I doubt that my neighbour mentioned me 7 weeks ago, because it's taken 7 weeks to contact me.

I'd appreciate an opinion. Can he get a warrant for my arrest based on this?

@CCTV. When the police come to visit, remind them of your complaints about your neighbour's behaviour. As long as your CCTV camera is only focused on your property, you have nothing to worry about.

I was arrested for somthing i did not do, many years ago, i was taken to court the next day and told to plead guilty by the accusing officer then i would be able to go home early, i did not plead guilty, because i was not guilty, i did not make a complaint against the police concerned, is it still possible to file a complaint now, or is it too late do do so?

I am after some advice I have had my household subjected to a misuse of drugs warrant 3 times now in the space of 9 months the 1st 2 times were for suspicion of cannabis and the last one was for cocaine as I do not engage in any practice of drugs misuse and on each occasion nothing was found or removed from my household. Have had several occasions to question who the actual criminals are . Believe that strathclde police force are more corrupt than the criminals they police . Would also like to add that it ia more than apparent that our court system is also corrupt ,that your bail is down to the police and not the court system and that these institutions are not independent like they would have you believe we do actually live in a police state

My son has been cautioned by the police for riding his motorbike on kerbs,in the park at the back of me, all sorts of complaints even coming home all hours of the night he does have a after market exhaust which has a distinct sound but legal!!!! There is a scooter riding round doing these things and drug dealing this is the person not my son but soon as they hear a loud exhaust they think it's my son , he hasn't lived at home properly for three months !!!!! There is a group of neighbours in our street and their parents that live on out estate and sister that they have clubbed together and did a petition to get rid of my son but the other neighbours wouldn't sign it!! They are bulling my family they complained to the council about me having chickens which they all clubbed together they are nasty people all because our sons fell out as children!!!!!! They have no proof what can I do?

Background information – My daughter has attended a small private school since the age of 7. My daughter took her GCSE French when she was 13. At that time I was helping with the invigilating at her school. As my daughter was the only student taking this GCSE I obviously could not invigilate. The Principal of the school said she would invigilate and I could man the office for her. I had to go downstairs into a classroom (I cannot remember why now) and I was astonished to find the Principal in there. She had left my daughter on her own in the examination room. The following week I was invigilating for 3 other students. Before the exam started they told me that when the Principal had invigilated a GCSE for them previously she had again left the room – thus leaving them unattended – totally out of order.
Just before the last Christmas holidays my daughter phoned me from school and told me that in assembly the Principal had told her and the other GCSE Art students that the subject for their controlled assessment would be “Edges”. I told my daughter that this was totally incorrect. I e-mailed the Principal and advised her that the Exam paper relating to the controlled assessment could not be given to the students until at least the 1 January in the year they were taking the GCSE. I also supplied her with links to the relevant website so that she could see for herself. I received an e-mail from her stating that they had always done the exam the same way and that is how they would be doing it. I did e-mail again but did not get anywhere. I then contacted another local school and spoke to their Exams Officer who confirmed that what I was saying was correct. She advised me that as it was Malpractice she would have to report the school to the relevant exam board. I was in school the last day of term before the Christmas holidays and the Principal said to me that she had to phone the examination board as they had left her a message. A short while later she came to find me and ask me to go to her office. Once inside the office she started shouting her head off at me – How dare you contact the exam board, you had no right – I did advise her that all she had had to do was check the link that I had e-mailed her – her response was that she was far too busy and had enough to do and now she had to write a letter explaining her actions to the exam board – she then shouted at me to get out of her school.
Since then it has been a nightmare for my daughter. When taking registration the Principal started calling out my daughters’ first name and surname whereas for all other students she continued just calling out their first name. She had previously said that my daughter could stay on and do her ‘A’ levels but she changed her mind after this incident. The Principal has not responded to my e-mails either. She then decided to refer my complaints to the Chairman of the Governors. I then requested a copy of their complaints procedure and I have followed it to the letter

Ive been spilt with my ex husband 4 and half years,with many court battles i got full custody of my daughter because of his very colourful background they also gave him a court order against him seeing his daughter at all, but yesterday he came to my property with a police officer without any warning and my daughter was here which my ex saw. Has the police got the right to do this or should they have warned me first to make sure my daughter wasnt here. Dont know who else to ask without being charged a fortune from a solicitor. Just need some advice before ringing the station to complain. Hope someone can help.

about 8 years ago my number plates were cloned and used in a robbery, that is what i was told when stopped by the police, i had to prove where i was when this happened, i was where im always at on a tuesdays selling aggrecultural products on melton mowbray cattle market unless ill or on holiday. since then periodically there has been a heavy presence of police where ever i go on foot or in my own vehicle, some of the intimidation is horrible, police vehicles screaming past towards me on a regular basis untill im a nervous wreck then they ease up, and i start recover, then it gets heavy again, i nearly took my own life just before last christmas, i only go out now when i have to, ive got no social life anymore, pleae please please can you help me ive done nothing wrong , and just want some sort of life back, when ive spoken to the police through a solicitor, mp margaret becket,and have been sobbing on the phone several times there reply everytime is it isnt happening, but it is , ive got a diary of events and some incidents on film . please please can you help me or guide me. regards gary burrows.

My friend who is a german national was implicated under a criminal case by his wife when she complained that he tried to strangulate her and kill her because he is seeing someone else while she does not understand the language at all, but managed to get her complaint registered in the police.
In the follow up of her complaint my friend was bycotted from his house for 15 days and she was immediately sent to a woman shelter with his kids. my friend however returned to the home after completing his 15 days, while she kept on staying in the women shelter with their kids.
My friend wrote mails to get her back and also his kids back, she joined him finally when he went to pick her up from the women shelter she was called back and started living with my friend after she took her complaint back and stated that she wants to live with him if he will never hurt her, beat her and repeat the offense again.
However, my friend tells me that his name is existing in the Computer Network of the German State and that the police did not accept his wife's latest statement, where she backed out with her complaint and also that the judge had ordered him to either pay a fine or undergo a sentence in the jail for 3 months.
When he filed an appeal for the same the review petition was dismissed and the judge ordered him to undergo a sentence in the jail for 4 months.
His Criminal lawyer just intimated him that his case is once again read by the judge to review his sentence and arrive at a final conclusion.Although, his criminal lawyer was of an opinion that it is really unsafe for him to live with his wife as a little altercation in between both of them could instigate her for her to make a complaint again and therefore he wanted to move out of the house, but can not do that since his name is existing in the computer.
Moreover, he wanted to divorce his wife and had applied for a divorce case that the lawyer did not file in the court, which happened to him twice.
I fail to understand what are the implications now as he wants to get divorced from her wants to keep his kids with him, which is possible as she does not understand the language but his name is existing in the German State Computer network and so he is unable to file for a divorce from her and has to live with her.
Is it true that your personal life and choices take a back seat and one cannot file for a application to get a house and to get a divorce from his wife even when your own criminal lawyer is of an opinion that it is unsafe to live with your spouse in such conditions, why is it not feasible to file for a divorce under such conditions, please help me and guide me with the same will be grateful for your kind help and support.

The police woke me up at 7.00 a.m. With a search warrant to take away my husbands computer....they were looking for something in particular (which he hadn't done). They cautioned me and took me to a police station (Ineither of us have been in trouble with the police...ever.). My hubby was abroad at the time .....I am disabled and 61 years old. When they realised I also have a computer they took mine and my iPad and my hubby's computer and his iPad. I spent all day (apparently voluntarily) being questioned about something I knew nothing about. While this was happening they searched the whole of my house., broke my toilet and a framed picture. They have had not charged either of us with anything and still have our computers (since 22nd November). What rights do I have if any for getting back my property?

I was given a dog as the owner could not cope with it, the dog is a 6 month old gsd,he also gave me all the dogs paper work, the kc papers, vet papers, food, bowls etc etc, I got the dog home and my wife said we can't have another dog in the house, I I advertised the dog for sale and sold the dog, to a security company, anyway, some 4 weeks later the org dog owner phoned me asking for his dog back I said no as the dog has gone, then the same week I had a call from the police stating that I had stolen the dog and that the org owner gave me the dog to train. I was asked to go into a police station to give my side of the story in which I did, some 3 months on, we had a call yesterday from the police asking if my wife would go into the police station and make a witness statement, she said yes but will be seeking legal advice, I would like to know why has this man lied and as caused all this upsetment, the man has got his dog back. so now I am waiting to hear if I will be charged with theft or not grrrr

Police came into my rented house this morning around 9am in search of my landlady but I clearly told them the landlady does not live here in this address, she lives in her another house and gave the contact number of the landlady. The person who seemed to be in-charge of the team, took my personal details, my wife's personal details and even my FIVE months old baby's personal details. Whilst I was giving the our personal details to the in-charge, an officer suddenly entered in to our bedroom without knocking or announcing where my wife was feeding my five months old in the bed and started to questioning her.. I was very much co-operative from the beginning however the behaviour of that particular officer driven me mad and I got angry I can not write everything here but this is my summery. My questions are;

1- Is this an acceptable or reasonable searching method ?
2- Do they have to take our personal details ? why my five months old baby's details?
3- Was entering into our bedroom without even notifying acceptable?

Kindly seeking comprehensive advise.

May of 2011, my ex husband & I were parked at the Flying J truckstop, eating burgers & listening to the radio, it was the night Bin Laden was killed. Around 11:30 pm, 2 SLCPD officers pulled up on us, guns pulled. Apparently my exes 'friend' called the police and told them we had been fighting with each other, we weren't fighting. We were both asked for our ID's. We both gave it to them. Our names were run and my ex was arrested. I asked my ex if he wanted me to hold his phone and one of the officers threw me up against my vehicle, handcuffed and told that I was being detained because I wouldn't be quiet. He then put me in the backseat. My ex was taken to jail and I was released. The officer didnt give me back my ID. I called the SLCPD and told them I didnt get my ID back. The officers came back, looked around for a couple of minutes. Didnt find it. One of the officers gave me a case #. Then he left. I want to be compensated for having to replace my ID.

-Co-operating with the Police
It will always be the best policy to co-operate with the police when they initially question you. If they ask for personal details such as your name and address then these should be given. If the police have stopped you with the intention of proceeding with a search then you do have the right to know the reason for the search. The police cannot search a member of the public without reasonable suspicion. If the police cannot give a valid reason then they should not continue with any search. Reasonable suspicion is not necessary if the suspect is in a designated stop and search area

When a police officer stops you, you do not have to give you details at all, if you have not committed a crime then you have the right to no give your details. The public must be made aware of this, not - "It will always be the best policy to co-operate with the police when they initially question you. If they ask for personal details such as your name and address then these should be given"

- Inform us the public of the correct Law not some "best policy to co-operate with the police"
If you have not committed a crime and the police know this but they still want your details, YOU DO NOT BY LAW HAVE TO GIVE YOUR DETAILS.

I have just came out of newquay police station where i was being intervied by
an x met officer by the name of pc phillips but he calls himself dc phillips ?
durring the interview i was givin a special warning due to the fact i was giving a no commet to everything he had to say ,i then asked pc phillips was he allowed to give me a special warning on a voluntary attendance to which he said yes i can do as i like ,i then asked him under what section of law /pace was he allowed to give me a special warning he replied i can do i as i like ,i then asked him under pace code Bsec2 sub sec 2,1 to stop the interview i let me refer to PACE he point blank refused me this right and continued to ask me questions to which i made no reply ten minutes later he stoped the tape and told me he was reporting me and i would recieve a summons blah blah ....
my point is are newquy police above the law as this seems to be common practice at newquey cornwall

After helping police in my home with an initial enquiry, what are my rights if they keep knocking on my door? Do I have to let them in? Can I be arrested for not letting them in? Should I see a solicitor before going any further with there enquiries?

I WAS ARRESTED BY POLICE BECAUSE THEY IMAGINED SOMETHING , I WAS DRIVING A CAR WHICH POLICE REFUSED TO BELIEVE EVEN THOUGH I HAD A FULL PETROL CAN ON ME DUE TO RUNNING OUT OF PETROL

I WAS ON MY WAY BACK FORM PETROL STATION . DUE TO BEING ARRESTED MY CAR WAS LEFT IN A RESIDENTS PARKING BAY AND I GOT A TICKET , IPCC ARE USELESS IN MY OPINION . HAS WELL HAS TELLING PEOPLE ABOUT THEIR "CIVIL RIGHTS" YOU SHOULD ALSO INFORM THEM THAT SOMETIMES "CIVIL RIGHTS REALLY DON'T MATTER AND POLICE DON'T BOTHER WITH THEM AND BREACH THEM WITHPUT ANY CONSEQUENCE
